We can review and optimise your US patent text for use in Europe, saving both you and your client official fees and optimising the chances of patentability. We can also carry out all the necessary formality procedures and documentation for filing as US originating patent in Europe & UK / GB / England. We are exceptionally skilled in patent prosecution and can act upon preprepared instructions, dialogue or simply based upon outline guidance.
Extending US rights into Europe
There are two opportunities, within the priority year, such as from a provisional US patent or usually later from a subsequently filed PCT/international patent application. Whilst there is no provisional European patent application the same effect can be achieved by limiting the official fees paid so that the application is registered but not examined. However, it is usually advisable to file a regular European patent application or if cost is an issue to file an equivalent United Kingdom patent application, without request for search. There is no English provisional patent application but the application fees are sufficiently low that filing a regular application without request for search achieves the same effect as United Kingdom provisional patent application might be thought to provide if it existed. When bringing a PCT patent application into Europe / international patent application and the principal question is usually regarding providing multiple claims dependency on the correct number of independent claims, these are which we are accustomed to assisting with.
